Business Method Patents

A recent decision of the Federal Court of Appeal, relating to the Amazon one-click ordering system, has overturned the decision of the Federal Court that had previously allowed the one click patent claims. The Appeal Court has referred the patent application back to the Commissioner of Patents for reconsideration on an expedited basis consistent with the reasons of the court. This decision may still be subject to appeal to the Supreme Court of Canada.

The Court held that Canadian patent law does not preclude the patenting of business method patents. The court also set out guidelines for determining the patenting of business method patents and, as a result, the Canadian Patent Office is looking into issuing new practice guidelines for its Patent Examiners. The court set out that the patentable subject matter must be determined by a purposive construction of the patent claims. The patentable subject matter must be something with physical existence, or something that manifests a discernible effect or change. For more details, a link to the decision is given below.

This has been a long and tedious process between the Patent Office and Amazon which started more than 13 years ago with the filing by Amazon of Canadian patent application Serial No. 2,246,933 on September 11, 1998.

Raymond Eckersley - Honorary Member of IPIC

We are pleased to announce that Raymond Eckersley was today made an Honorary Member of the Intellectual Property Institute of Canada.

Ray received his Honorary Membership at the Institute's Gala Dinner during its Annual General Meeting in Quebec City. Ray was recognized for his 64 years of membership in the Institute during which time he served 7 consecutive years on the council of the institute including serving as President in 1982. Ray has been attending Annual General Meetings since 1946 and has seldom missed a meeting.

Ray has always been and continues to be a staunch supporter of the role the Institute plays in the development of the Intellectual Property profession in Canada and its role abroad.

Congratulations Ray on becoming an Honorary Member.

Tanner Hukezalie Passes 2009 Patent Agents Qualifying Exams

We, at Craig Wilson and Company, are pleased to announce that Tanner Hukezalie has passed the 2009 Canadian Patent Agents Qualifying Examination and that his name has been added to the register of Canadian patent agents.

Tanner passed all 4 qualifying papers on his first sitting of the Examination. This is quite an accomplishment for Tanner since Canadian Patent Office Statistics released in a 2008 report (see link) show that for the last 5 years, the percentage of successful candidates to pass all 4 qualifying papers on their very first sitting of the Examination has varied between a 3 and 9 percent rate of success.

Google Barcode Logo Celebrates 57 Years of Barcode Patent
